Thank you for your interest in BIOdyssey and its programs and events, organized by BIOdyssey S.R.L. BIOdyssey S.R.L., a Romanian legal entity, organized and existing under the laws of Romania, having its registered office located in Bucharest, registered with the Trade Registry under no. J40/19416/2022, having sole registration code 46929767, duly represented by Thomas Stoop, in his capacity as Administrator, acts as your counterpart in this agreement. BIOdyssey S.R.L. shall further be represented by persons assigned by it to act as its representatives for the purposes of this agreement or specific parts of this agreement.
These persons shall collectively be referred to as “the organization” or “BIOdyssey”.
These general terms and conditions apply to all transactions regarding the purchase of any and all tickets to any program offered by BIOdyssey.
All tickets are strictly personal. Participants must be 18 years or older.
Persons wishing to participate in any program by BIOdyssey, will need to apply for registration by filling out the application form, located on the respective event page on the official website of BIOdyssey. The organization will review your application, and will let you know if you are eligible for registration by e-mail. An invoice will be sent after you have received information confirming your eligibility. Registration will only take place after the date of bank transfer for the respective fee and is complete, after confirmation by the organization in writing. Payments can only be made according to the payment procedure on the official BIOdyssey website.
Information concerning the program and/or a specific event as part of the program shall be communicated to the e-mail address provided by you in the application form. Some of the information provided on this website and through e-mail may be subject to change, including but not limited to dates, times, locations, the persons involved in a specific program or event, or the circumstances under which it takes place (e.g. online or offline): though the organization endeavours to provide all participants with accurate information in advance, it cannot exclude the possibility that such changes are necessary, in which case this shall be decided at the sole discretion of the organization.
For events which are part of a BIOdyssey program, which do not require any payable fee, registration takes place after confirmation by the organization in writing, without any bank transfer.
3. CANCELLATIONS & REFUNDS:
Cancelling by the participant is possible, in writing to the organization, until 1 month before the start of the program. If the cancellation is requested later than 1 month before the start of the program, the participant will not be eligible for a refund. An application can nevertheless always be cancelled within 14 days (“cooling-off period”) after transmission of the online application form as indicated by EU law concerning consumer protection.
In case of cancellation by the organization, the participant will be refunded the full purchase price of the ticket if the cancellation was not reasonably attributable to the participant. Any claims on grounds of cancellation for an amount higher than the ticket price are excluded in advance.
Exchanging tickets is not possible: all tickets are sold on a personal basis.
In case of a force majeure situation, which explicitly does include (but is not limited to) war, terrorism, chemical, biological or nuclear disasters, large-scale riots, declarations of state-of-emergency or state-of-alert by the governing authorities (or other emergency decrees, decisions, regulations or laws of any kind restricting events or large-scale gatherings), or pandemic situations (including COVID-19 and Monkeypox virus-related outbreaks) within Romania, Ilfov County or the City of Bucharest, the organization retains the right to re-schedule the event under the same conditions, and/or move any/all BIOdyssey events online, regardless of the timing of invocation of force majeure by the organization. In this case, the organization shall not be obligated to refund the participation fee or any other related expenses to the participant. Force majeure may only be invoked by the organization.
BIOdyssey S.R.L., its affiliated organizations and partners, or their officers, employees, volunteers or other connected persons, shall not be liable for damage to the applicant/participant’s person or property of any kind before, during or after an event, related to participation in BIOdyssey. The organization reserves the right to refuse participants at all times and to remove participants in cases of improper conduct, at the discretion of the organization.
Any damages caused by the participant to third parties, or to BIOdyssey S.R.L. and its affiliated organizations and partners, or their officers, employees, volunteers or other connected persons during the course of BIOdyssey or in connection with participation in any of its events, shall be indemnified by the participant without delay.
5. PRIVACY STATEMENT
By agreeing to these terms and conditions, you are also explicitly agreeing to the processing of your personal data for the purposes of marketing the event, keeping track of the registrations and payments, improving the event and adjusting specific aspects of the event, and communicating with you before, during and after the event. Further information is found in the separate privacy statement, found in the respective application forms. Explicit agreement to our privacy statement is ensured by separate statement of agreement by you in the application forms themselves.
6. COMMUNICATION METHOD
Any and all communication in writing between participant or applicant, and the organization of BIOdyssey, as referred to in these terms and conditions, shall take place electronically through the application forms found on the official website of BIOdyssey (www.biodyssey.eu), or by e-mail with email@example.com.
7. DISPUTE RESOLUTION AND CONFLICT OF LAWS
On this agreement, Romanian law is applicable in its entirety. In case of any dispute, the matter will first be handled amicably. In case this fails, the matter may be referred to the District Court Bucharest which shall be solely competent to hear such case. In case any of the terms of this agreement are found to be invalid, the remaining part of the agreement remains in force.
8. CODE OF CONDUCT
Participation in any and all events of BIOdyssey require agreement with our Code of Conduct, which can be found here, and is an integral part of these terms and conditions.
Persons entering any BIOdyssey program also consent to conform to any regulations in place, concerning measures against the spread of the COVID-19 virus. These regulations may include (but may not be limited to) possession of proof of vaccination, recovery and/or a recent negative virological test result from a recognized test location. These regulations may be required for entry into Romania and/or the use of, and access to any public and/or private facilities within the Romanian territory, including public transportation, hotels and any other BIOdyssey program locations. It may also include the mandatory wearing of protective equipment, such as surgical masks in- and/or outdoors. Participants are also agreeing to inform BIOdyssey timely of any issues concerning any such restrictions in your personal case, and to take responsibility for abiding by these regulations for the duration of participation in any BIOdyssey program. The same applies to any other measures taken against any other transmissable diseases, such as Monkeypox.
